HLURB’s revised guidelines will help make property seekers’ decision-making easier by equipping them with the right information.
When you’re looking to secure property, where do you start? For most, they are able to gain access to choices by seeing advertisements, whether these are populated online or elsewhere. It is understandable, as future buyers, for people to rely on such venues for the most accurate and complete information on their potential homes.
However, it isn’t always the case in real life. For this reason, the role of the Housing and Land Use Regulatory Board, or HLURB, is vital. As the agency primarily tasked with policy development, planning and regulation on matters such as housing and land development, the HLURB protects prospective buyers of property from fraud and other malpractices in the industry.
The agency accomplishes this by releasing implementing rules and regulations (IRR). Just recently, they released an IRR for the Subdivision and Condominium Buyers’ Protective Decree (also known as Presidential Decree No. 957).
For brokers, it is necessary to get to know these guidelines set by the HLURB, but for potential property buyers, it certainly won’t hurt to be aware, especially if it minimizes risk. Here are a few important points from the IRRs:
What Counts as Advertisement
An advertisement is “any form of information” relating to a project, its operations, and activities, in order to market and sell the property. These advertisements are rampant in all forms of media and can be created by owners, developers, brokers, and salespersons—making them liable for misrepresentations.
Remember, an advertisement is different from an “announcement.” Announcements are generally made just by the real estate project’s owners and developers.
Registration is a Must
To protect potential buyers from potential malpractices, brokers, dealers, and salespersons are required to be registered with the Professional Regulatory Board of Real Estate Service (PRBRES). Also, before dealing with projects registered with the agency, real estate workers need to be registered with the HLURB. Further, PRBRES-licensed brokers and PRBRES-accredited salespersons and business firms with HLURB-registered projects must register with the HLURB. Always make sure the people you are dealing with are duly registered; meanwhile, for brokers and salespersons, this is a way to establish trust and accountability with your clients right off the bat.
Take Note of the Specifics
Whenever coming up with advertisements for projects, whether subdivisions or condominiums, make sure to include the following specifications:
- Unless the complete payment and financing scheme is disclosed in the ad, there should be no mention of any means of payment or financing on the advertisement.
- Photos used in the advertisement must always be captioned appropriately. Ads must specify whether depictions of the property are the artist’s illustrations, actual photos, or architect’s rendering.
- Distance stated should not be misleading. Thus, when stating distances in the advertisements, including when describing the property’s distance from certain landmarks, express it accurately in kilometers.
- The Truth in Advertising
Always seek the truth in advertising real estate, whether you’re a broker or buyer. If you’re creating them, advertisements must always reflect the project or property in its actual state, and should not be meant to sway the public through misleading depictions. Facilities, infrastructure, and other types of developments must be accurately depicted.
So you’re a buyer and you think a particular project is too good to be true? It probably is. Make sure to look for the following information first when coming across a piece of advertising:
- Name of owner and developer of the project
- License to Sell or Amended License to Sell number
- Advertisement approval number
- Approved project completion date
- The maximum selling price (only for economic and socialized housing projects)
Make Informed Decisions with these Guidelines
Thanks to the revised IRRs, advertisements are just as good as real estate warranty, in that owners and brokers are made responsible for any representations in ads they submit to the HLURB for signing, and which the HLURB subsequently releases to the public. This means, failure to deliver on the terms—in a complete and timely manner–will result in a breach of contract, where there are corresponding fees and penalties.
For buyers, it is incredibly important to be vigilant regarding the information presented in advertising, so that this aids in their decision-making. Only after considering advertisements in accordance with these set guidelines can a buyer make an optimal, informed choice. Brokers also need to do their part in safeguarding the buyer’s choice by seeking fair, straightforward representations of their potential future home.

Pag-IBIG Fund grants 21,000 socialized housing loans to low-wage earners in 2018
Pag-IBIG Fund released P8.36 billion for socialized housing in 2018, benefiting 21,389 borrowers who are minimum-wage and low-income earners.
“Pag-IBIG Fund released an all-time high of P 75.31 billion in home loans in 2018. P8.36 billion of this amount was for socialized housing. In terms of units, 24% of the 90,375 homes financed by Pag-IBIG Fund in 2018 were for low-income borrowers. Pag-IBIG Fund continues to heed the call of President Rodrigo Roa Duterte to provide social benefits to more Filipinos and strengthened its position as a key mover in the BALAI (Building Adequate, Livable, Affordable and Inclusive) Filipino Communities Program of the government’s housing sector,” said Sec. Eduardo D. del Rosario, Chairperson of the Housing and Urban Development Coordinating Council (HUDCC) and Pag-IBIG Fund Board of Trustees.
Pag-IBIG Fund Chief Executive Officer Acmad Rizaldy P. Moti explained that Pag-IBIG’s tax-exempt status enables the agency to subsidize the low rates for socialized housing loans and improve its programs to cater to the needs of the underserved sector.
In 2017, Pag-IBIG Fund reduced the interest rate for socialized housing from 4.5% per annum to only 3% per annum for socialized housing units worth up to P450,000, which is the best rate in the socialized housing market.
And while the price of socialized housing ceiling was raised by the HUDCC to P580,000 for horizontal housing projects in 2018 to improve the quality of affordable homes, officials of Pag-IBIG Fund decided to keep the rate low. Under its Affordable Housing Program which is exclusively for minimum-wage and low-income earners, Pag-IBIG still offers 3% per annum for loans up to 580,000.
This means that qualified borrowers of the Affordable Housing Program will only have to pay P2,445.30 a month for the first five years of a P580,000 loan with a term of 30 years.
PAG-IBIG FUND TO KEEP HOUSING RATES LOW AND DIVIDEND PAYOUT HIGH
Despite the steep inflation and currency depreciation, top executives of Pag-IBIG Fund remain confident that they can maintain the low interest rates of the agency’s home loans and cash loans.
Pag-IBIG Fund currently offers the best rates in its loan programs. Pag-IBIG home loans offer the lowest rate of 3% per annum for loans up to P 580,000 under the Affordable Housing Program and rates as low as 5.375% per annum for loans up to P 6 million under the Fund’s regular housing loan program. Meanwhile, Short-Term Loans or cash loan programs known as Multi-Purpose Loan and Calamity Loan come with rates of 10.5% per annum and 5.95% per annum, respectively.
“The year is not over yet but Pag-IBIG Fund already performed better than expected. There was strong demand for and availment of our housing and cash loans in the last three quarters. We are very confident that the rates of Pag-IBIG Fund will remain low and we don’t foresee an increase in housing interest rates in the next few years because of the strong financial standing of the Fund. These low rates directly benefit Pag-IBIG members and contributes greatly to the anti-poverty agenda of the administration of President Rodrigo Roa Duterte and the BALAI Filipino program of the government’s housing sector,” said Sec. Eduardo D. del Rosario, Chairperson of the Housing and Urban Development Coordinating Council (HUDCC) and Pag-IBIG Fund Board.
From January to September, Pag-IBIG released over P 51.76 billion to help borrowers buy 62,665 homes. Cash loans, on the other hand, amounted to P 37.42 billion which was released to more than 1.8 million borrowers. Home loans released in the last nine months are higher by 14% in terms of amount released and 11% higher in the number of homes financed compared to the same period last year. Cash loans, on the other hand, remained steady but the number of loans approved increased 7%.
“Aside from the strong demand for our home loan programs, our efforts to improve our home loan portfolio have paid off. We maintained our performing loans ratio at 90% even as we cater to minimum-wage earners who are shunned by banks. And because we are now more efficient, we were able to achieve double digit growth in our home loan collections. We collected P 41.49 billion in home loan payments from January to September. This is 10% higher than the P 37.80 billion we collected in the same period last year. Cash loan payments amounted to P 40.08 billion, which is an increase of 2% from 2017,” said Pag-IBIG Fund Chief Executive Officer Acmad Rizaldy P. Moti.
CEO Moti added that with such strong financial showing, Pag-IBIG Fund will again achieve record-breaking income in 2018, higher than the P 30.27 billion net income the Fund posted in 2017.
“We expect to maintain this upward trajectory until the year ends. So, we are set to surpass our P 30.6-billion net income target by P 1 billion or P 2 billion despite offering such low rates. This is the ultimate win-win situation because our borrowers are treated to one of the lowest, if not the lowest, rates in the market. The low rates fuel demand, which in turn helps improve our net income. And when our net income is high, all Pag-IBIG members can expect to benefit from dividend payouts which are much higher than what they earn from other financial institutions. We foresee our dividend rate to be somewhere between 6.5% and 7%, which will be credited to members’ accounts early next year. All these benefits are being enjoyed by our members without increasing the monthly mandatory membership savings of only P100 since 1982. This really is what Lingkod Pag-IBIG is all about,” CEO Moti said.

Pag-IBIG Fund releases highest-ever P47B in multi-purpose loans in 2018; 2.3M members assisted, up 11%
Pag-IBIG Fund released P46.96 billion in multi-purpose loans or MPL last year, the highest ever released in a single year and posting growth of P1.58 billion or 4 percent higher than the amount released in 2017.
The amount assisted 2,268,715 members with their immediate financial needs, 11 percent more than in 2017.
“Pag-IBIG Fund’s performance in 2018 is outstanding. Among our record-breaking feats is the amount we disbursed as multi-purpose loans which many of our members rely on. The amount of cash loans and the number of borrowers have been steadily increasing since 2016 because more and more members are turning to Pag-IBIG Fund for their financial needs. Pag-IBIG Fund released P46.96 billion in multi-purpose loans or MPL last year, the highest ever released in a single year and posting growth of P1.58 billion or 4 percent higher than the amount released in 2017.
The amount assisted 2,268,715 members with their immediate financial needs, 11 percent more than in 2017.
“Pag-IBIG Fund’s performance in 2018 is outstanding. Among our record-breaking feats is the amount we disbursed as multi-purpose loans which many of our members rely on. The amount of cash loans and the number of borrowers have been steadily increasing since 2016 because more and more members are turning to Pag-IBIG Fund for their financial needs. Pag-IBIG Fund reminds employers to avail of Penalty Condonation Programs as deadline nears
To improve the plight of more Filipino workers, Pag-IBIG Fund reminds employers to settle their obligations before its penalty condonation programs expire by mid-year.
“Pag-IBIG Fund continues to heed the call of President Rodrigo Roa Duterte to provide social benefits to more Filipinos. Pag-IBIG savings is one of the workers’ benefits so this is why we are going after unregistered and delinquent employers who are not giving what is due to their employees. We are offering penalty condonation programs to employers to improve compliance. This way the employees get to enjoy their Pag-IBIG membership while we offer payment plans under our penalty condonation programs to ease the burden on employers. It’s a win-win situation for all parties involved,” said Secretary Eduardo D. del Rosario, Chairperson of the Housing and Urban Development Coordinating Council (HUDCC) and Pag-IBIG Fund Board of Trustees.
The Fund is currently offering two penalty condonation programs: one under Circular No. 416 for employers who did not deduct Pag-IBIG monthly savings from employees and another under Circular No. 411 for those who deducted monthly savings but did not remit these to Pag-IBIG Fund. Under the two Circulars, unregistered and delinquent employers will be given two payment options and terms that best suit their capacity.
Employers covered by Circular No. 411 only have until June 26, 2019 to settle while employers covered by Circular No. 416 only have until August 13, 2019 to do so.
So far, more than 6,100 unregistered and delinquent employers availed of the penalty condonation programs. They have collectively remitted P260 million in monthly savings for over 194,000 employees who were previously deprived of the benefit. With the employers’ compliance, these employees now have an updated membership and can fully enjoy the benefits and services of Pag-IBIG Fund.
“Pag-IBIG Fund is offering the penalty condonation program to help employers comply with the law. Since 2017, we already helped delinquent employers save a total of P200 million in penalties. As we work to allow more workers to become members of the Fund, we want to make sure that their monthly savings are remitted properly and on time by their employers because it is their right. We would like to remind them that under RA 9679, saving for the future is a joint effort of employees and employers,” said Pag-IBIG Fund Chief Executive Officer Acmad Rizaldy P. Moti.

Alam natin na hindi tayo perpekto at maraming iba pa ay hindi perpekto, kung gusto nilang maniwala o hindi. Ang bawat isa ay may sariling mga natatanging mga kakulangan at tungkulin nating maghanap ng paraan kung paano natin sila mapalakas. Huwag hayaan ang mga taong nakapaligid sa iyo, tukuyin kung sino ka. Huwag hayaan silang magdikta at limitahan ka. Dapat mong malaman na maaari kang gumawa ng mas higit na mga bagay kahit na ikaw ay may depekto. Kung magsisimula tayo sa paggawa ng "pag-iisip bago ka magsalita" isipin kung gaano ang mas mabuti ang mundo. Marahil ito ay maaaring maging lubhang napakalaki.
